Booking conditions : RENTAL OF THE COTTAGE
GENERAL CONDITIONS OF SALES 2024
By signing the contract for Domaine de l?Eau Vive (Largentière 07110), I certify that I have read the general conditions of use opposite. In accordance with article L-221-28 of the Consumer Code, the provision of accommodation services is excluded from the legal right of withdrawal.
1- SERVICES: The Domaine de l?Eau Vive welcomes you every day at the reception from 8:00 a.m. to 11:00 a.m.
from 5:00 p.m. to 10:00 p.m. Renting our gîtes gives access to all of the Domaine?s services and our swimming pool.
2- RESERVATIONS: the rental is effective after:
The reservation only becomes final after receipt of the duly completed and signed contract, accompanied by a 30% deposit, before the date indicated on the contract. After this date, the owner will have access to the accommodation and this contract will be canceled. The balance of the rental will be paid on the day of your departure. All bank charges remain the responsibility of the tenant. Checks should be made payable to Domaine de l?Eau Vive. The tourist tax paid to the Public Treasury is paid with the balance of the stay (exempt minors). The eco-contribution corresponding to the special charge for household waste is also paid with the balance of the stay and is equal to ?0.90 per adult per night.

The rental of our cottages is nominative and cannot be sublet or transferred to a third party.
Any special request must be addressed to us and must be subject to our agreement with confirmation by e-mail or post.
3- PAYMENT: the balance of the amount of your stay must reach Domaine de l?Eau Vive no later than 1 month before the planned date of your arrival. If the balance is not received within the above deadlines, we draw your attention to the fact that we will consider your rental as canceled.
4 ? USE OF THE PREMISES: The tenant will enjoy the rental and make good use of it, in accordance with the purpose of the premises. Rental cannot under any circumstances benefit third parties, without prior agreement from the establishment manager. The tenant may not, under any circumstances, claim any right to remain in the premises at the expiration of the rental period initially provided for in this contract, unless agreed by the establishment manager. No modification will be accepted in the wording of the contract without the agreement of both parties. The tenant must report any changes concerning modifications to the contract before arrival (date of stay, number of occupants, etc.).
In particular, there must be total silence between 11 p.m. and 8 a.m. The customer undertakes to comply with this instruction and to have it respected by his entire family.
5- CANCELLATION:
-if the cancellation occurs more than 2 months before the scheduled arrival date, we undertake to refund the entire deposit paid.
- in the following cases, in the event of cancellation, the amounts that will be retained and requested will be as follows:
- if the cancellation occurs more than 1 month (and less than 2 months) before the scheduled arrival date, we will retain the deposit that has been paid.
- if the cancellation occurs less than 1 month before the scheduled arrival date or if you do not show up on the scheduled date, you will be charged the full amount of your stay.
- in the event of early departure, you will be charged the full amount of your stay
6- REFUND:
We will provide a partial or total refund for your stay in the following situations:
- death of a person in your direct family: parents, brothers, children
- Job Loss
- accident requiring immobilization at your home
- serious illness
This reimbursement will be made after presentation of supporting documents and agreement on our part.
7- DEPOSIT:
For the rental of our cottages, you will be asked for 2 deposits upon your arrival:
- 400 euros to guarantee accommodation in good condition. It will be returned to you before your departure following the inventory. If the latter cannot be achieved, the deposit will be destroyed or returned by mail. In the event of equipment breakage, refer to the inventory sheet.
- 150 euros relating exclusively to the cleaning and cleanliness of the gîte. In the event of insufficient cleaning or if you do not wish to do it yourself, this sum will be used to make the accommodation you have found as clean as possible for new tenants.
The rental equipment is subject to a quantified inventory. The inventory of fixtures and furniture inventory
and various equipment will be made by the tenant on the day of his arrival. Any claim relating to
on the inventory, condition, cleaning in your accommodation must be mentioned in writing on the condition of the
places provided for this purpose and delivered no later than the day after your arrival before 12 p.m. After this time,
no complaints will be taken into account and the tenant will be held responsible, upon departure,
possible damage or missing items. In case of absence of the tenant for the inventory of departure and the
handing over the keys, only the inventory carried out by the owner will be retained.
8 - NUMBER OF PEOPLE: The number of people cannot exceed 8 people. Exceptionally and subject to prior agreement from the owner for one person, this rule may be waived. In this case the owner will receive an increase of ?15/person/day.
9 - VISITORS: Any one-off or daily visit to tenants during their stay must be reported to the establishment manager and may be subject to additional billing. Access to the swimming pool is prohibited.
10 ? SWIMMING POOL: The swimming pool at Domaine de l?Eau Vive is a private swimming pool. It is free and reserved for people declared on the information sheet attached to the reservation contract. Swimming pool opening time: 10:00 a.m. to 8:00 p.m. The gate opening handle is a safety system; you must at the same time lift the top striker while turning the handle! DON?T FORCE!!! Children must be accompanied by an adult. The swimming pool is unsupervised, the child's companion must exercise constant and active supervision. It is obligatory to put a waterproof diaper on untrained children. Our animal friends are prohibited within the pool area. All safety instructions are reminded on the display at the entrance to the swimming pool! Any visitor or guest does not have access to the swimming pool! For hygiene reasons, only swimming trunks are allowed in the pool. Safety instructions relating to the use of all play and leisure equipment must be scrupulously respected. ? Children are the full responsibility of their parents who must ensure their safety.
11- ARRIVAL: on the scheduled day of your arrival, the rental will be ready for 5:00 p.m. In the absence of a written message from you (registered mail or e-mail), the rental will become available again no earlier than 48 hours after the arrival date mentioned in your rental contract. In this case, we remind you that full payment for your stay will be required. Simple phone calls or text messages are not permitted.
12 - INTERRUPTION OF THE STAY: In the event of delayed arrival, premature departure or interruption of the stay by the tenant, no reimbursement will be made, apart from the deposit.
13- Departure: on the day of scheduled departure, the rental must be fully vacated and clean no later than 11:00 a.m.
14- ANIMALS: we accept animals in the cottages and we ask that they be kept on a leash in all interior and exterior areas of the Domaine. Tattoos, collar or chip as well as vaccination certificate are mandatory.
Attack dogs (1st and 2nd category) are prohibited. Pets must be indicated when booking and mentioned on the rental contract (breed, size). The presence of an animal will be charged 15 euros regardless of the length of stay and whatever the animal. The hidden presence of an animal will be charged double, i.e. ?60. They must be clean, sociable (towards children and other animals) and not cause any nuisance to other tenants (noise, smell, aggressiveness, wandering on the property). For its needs, the animal will be taken away from the common areas of the accommodation and for the sake of cleanliness the droppings must be immediately collected by the animal's owner. Each animal will be kept on a leash. In the event of non-compliance with these conditions, after a first oral warning, the owners of Domaine de l'Eau Vive will be obliged to exclude the domain without reimbursement of the remaining days. On the day of departure, the vacuum cleaner will be systematically vacuumed by the owner of the animal (even in the event of a cleaning service requested). For any blanket, duvet, cover requiring cleaning (hair, dirt), it will be retained from the deposit. sum of ?30/duvet, cover or cover.
You can choose the cleaning option on the day of your departure for 75 euros.
15- INSURANCE: all occupants regularly registered at reception will be able to benefit from the
civil liability guarantee for all bodily injury or material damage for which our
liability will be legally recognized.
16 - AIR CONDITIONING: As we do not like waste and waste and always to minimize
our ecological impact, we have also set up a counter for each installation

17 ? PARKING: Vehicles must be parked in the parking lot provided for this purpose.
18 - LIABILITY: The owner cannot be held liable in the event of:

? Breakdown or decommissioning of technical equipment.
? Domaine de l?Eau Vive cannot be held responsible for fortuitous events, force majeure (catastrophes
climatic conditions) or nuisance which would disturb, interrupt or prevent the stay.
? The Management declines all responsibility and is not liable for any damage caused or suffered
by vehicles parking or circulating within the premises of the establishment.
19 - COMPLAINTS: All complaints relating to the conditions of the stay must be made on site to the establishment manager to enable him to find an immediate solution.
20 - PHOTOGRAPHIC CLICHES: As part of the establishment's communication and activities or events, photographic photographs can be taken and used on the establishment's communication brochures. Acceptance of the rental conditions entails acceptance of the rights to use these photos without being able to claim image rights whether for adults, children or adolescents. If you refuse this clause, a written certificate must be submitted to the establishment manager before the end of your stay. If applicable, this clause will be considered accepted and cannot be called into question subsequently for any reason whatsoever. DISPUTE ? CONSUMER MEDIATION: In the event of a dispute between the Customer and the company, they will endeavor to resolve it amicably (the Customer will send a written complaint to the Customer Relations Department of the Manufacturer or that of the Seller ).
