Booking conditions : GENERAL SALES CONDITIONS 2023
By signing the Domaine de l'Eau Vive contract (Largentière 07110), I certify that I have read the general conditions of use opposite. In accordance with Article L-221-28 of the Consumer Code, the provision of hosting services is excluded from the legal right of withdrawal.
1- SERVICES: The Domaine de l'Eau Vive welcomes you every day at the reception from 8:00 to 11:00 a.m.
from 4 p.m. to 10 p.m. The rental of our gîtes gives access to all the services of the Domaine and to our swimming pool.
2- RESERVATIONS: the rental is effective after:
The reservation becomes final only after receipt of the duly completed and signed contract, accompanied by a 30% deposit, and this, before the date indicated on the contract. After this date, the owner will dispose of the accommodation and this contract will be cancelled. The balance of the rental will be paid on the day of your departure. All bank charges remain the responsibility of the tenant. Checks should be made payable to Domaine de lEau Vive. The tourist tax paid to the Public Treasury is paid with the balance of the stay (minors exempt). The Eco Contribution corresponding to the special fee for household waste is also paid with the balance of the stay and is equal to 0.60 per adult and per night.

The rental of our cottages is personal and cannot be sub-leased or transferred to a third party.
Any special request must be addressed to us and must be the subject of our agreement with confirmation by e-mail or post.
3- PAYMENT: the balance of the amount of your stay must reach the Domaine de l'Eau Vive no later than 1 month before the scheduled date of your arrival. In the absence of receipt of the balance within the above deadlines, we draw your attention to the fact that we will consider your rental as canceled.
4 USE OF THE PREMISES: The tenant will enjoy the rental and make good use of it, in accordance with the destination of the premises. The rental can in no way benefit third parties, except with the prior agreement of the establishment manager. The tenant may not under any circumstances claim any right to remain in the premises at the end of the rental period initially provided for in this contract, except with the agreement of the establishment manager. No modification will be accepted in the drafting of the contract without the agreement of both parties. The tenant must notify prior to his arrival of any changes concerning changes to the contract (date of stay, number of occupants, etc.).
In particular, silence must be total between 11 p.m. and 8 a.m. The customer undertakes to comply with this instruction and to ensure that all of his family respect it.
5- CANCELLATION:
- if the cancellation occurs more than 2 months before the scheduled arrival date, we undertake to refund you the full deposit paid.
- in the following cases, in the event of cancellation, the amounts that will be retained and requested will be as follows:
- if the cancellation occurs more than 1 month (and less than 2 months) before the scheduled arrival date, we will retain the deposit that has been paid.
- if the cancellation occurs less than 1 month before the scheduled arrival date or if you do not show up on the scheduled date, you will be charged the full amount of your stay.
- in case of early departure, the full amount of your stay will be charged
6- REIMBURSEMENT:
We will proceed to the partial or total refund of your stay in the following situations:
- death of a person in your direct family: parents, brothers, children
- Job Loss
- accident requiring immobilization at your home
- serious illness
This reimbursement will be made after presentation of supporting documents and agreement on our part.
7- DEPOSIT:
For the rental of our cottages, you will be asked for 2 deposits on your arrival:
- 400 euros for guarantee of accommodation in good condition. It will be returned to you before your departure following the inventory. If the latter could not be achieved, the deposit will be destroyed or returned by mail. In case of broken equipment, refer to the inventory sheet.
- 150 euros exclusively concerning the cleaning and cleanliness of the gîte. In case of insufficient cleaning or if you do not want to do it yourself, this sum will be used to make the accommodation as clean as you have found for new tenants.
The rental equipment is the subject of an encrypted inventory. The inventory and inventory of furniture
and various equipment will be made by the tenant on the day of his arrival. Any complaint relating to
on the inventory, the state, the cleaning in your accommodation must be mentioned in writing on the state of the
places provided for this purpose and delivered no later than the day after your arrival before 12 noon. After this time,
no complaint will be taken into account and the tenant will be held responsible, when he leaves,
any damage or missing items. In the event of the tenant's absence for the departure inventory and the
delivery of the keys, only the inventory made by the owner will be retained.
8 - NUMBERS OF PEOPLE: The number of people cannot exceed 8 people. Exceptionally and subject to the prior agreement of the owner for one person, this rule may be waived. In this case the owner will receive an increase of 15 /person/day.
9 - VISITORS: Any occasional and daily visit to tenants during their stay must be reported to the establishment manager and may be subject to additional invoicing. Access to the swimming pool is prohibited.
10 SWIMMING POOL: The Domaine de lEau Vive swimming pool is a private swimming pool. It is free and reserved for persons declared on the information sheet attached to the reservation contract. Pool opening hours: 10 a.m. to 8 p.m. The gate opening handle is a safety system, you must at the same time lift the striker from above while turning the handle! DO NOT FORCE!!! Children must be accompanied by an adult. The pool is unsupervised, the child's guide must exercise constant and active supervision. It is mandatory to put on a waterproof diaper for unclean children. Our friends the animals are prohibited in the enclosure of the swimming pool. All the safety instructions are recalled on the display at the entrance to the swimming pool! Any visitor or guest does not have access to the swimming pool! For hygiene reasons, only swimming trunks are allowed in the pool. The safety instructions relating to the use of all play and leisure equipment must be scrupulously respected. Children are the full responsibility of parents who must ensure their safety.
11- ARRIVAL: the scheduled day of your arrival, the rental will be ready for 4:00 p.m. In the absence of a written message from you (registered mail or e-mail), the rental will become available again at the earliest 48 hours after the arrival date mentioned in your rental contract. In this case, we remind you that full payment for your stay will be required. Simple phone calls or text messages are not allowed.
12 - INTERRUPTION OF THE STAY: In the event of late arrival, premature departure or interruption of the stay by the tenant, no refund will be made, apart from the deposit.
13- Departure: on the day of the scheduled departure, the rental must be fully vacated and clean by 11:00 a.m. at the latest.
14- ANIMALS: we accept animals in the cottages and we ask that they be kept on a leash in all the interior and exterior spaces of the Domaine. Tattoos, necklace or chip as well as the vaccination certificate are compulsory.
Attack dogs (1st and 2nd category) are prohibited. Pets must be reported when booking and mentioned on the rental contract (race, size). The presence of an animal will be charged 15 euros regardless of the duration of the stay and regardless of the animal. The hidden presence of an animal will be charged twice, i.e. 60. They must be clean, sociable (towards children and other animals) and not cause any nuisance for other tenants (noise, smell, aggressiveness, rambling on the estate). For its needs, the animal will be taken away from the common areas to the accommodation and for the sake of cleanliness the droppings must be immediately picked up by the owner of the animal. Each animal will be kept on a leash. In the event of non-compliance with these conditions, after a first oral warning, the owners of the Domaine de l'Eau Vive will be obliged to proceed to the exclusion of the domain without reimbursement of the remaining days. The day of departure, the vacuum cleaner will be systematically passed by the owner of the animal (even in the event of cleaning service requested) For any blanket, duvet, cover requiring cleaning (hair, dirt), it will be deducted from the deposit a sum of 30/duvet, cover or blanket.
15- INSURANCE: all occupants regularly registered at the reception will be able to benefit from the
civil liability coverage for all bodily injury or material damage for which our
liability will be legally recognized.
16 - AIR CONDITIONING: As we do not like waste and mess and always to minimize
our ecological impact, we have also set up a counter for each installation
electricity on which a flat rate for electricity consumption associated with air conditioning, if people
exceed this package, they will pay this electricity consumption in addition! Through this measure, we
hope to make holidaymakers responsible for a good reasoned use of air conditioning.
17 PARKING: Vehicles must be parked in the parking lot provided for this purpose.
18 - LIABILITY: The owner cannot be held liable in the event of:
Theft, loss or damage of any kind whatsoever, during or following a stay.
Breakdown or decommissioning of technical equipment.
The Domaine de l'Eau Vive cannot be held responsible for fortuitous events, force majeure (catastrophes
climate) or nuisance that would disrupt, interrupt or prevent the stay.
The Management declines all responsibility and is not liable for any damage caused or suffered
by vehicles parked or circulating within the premises of the establishment.
19 - COMPLAINTS: All complaints relating to the conditions of the stay must be made on site to the establishment manager to enable him to find an immediate solution.
20 - PHOTOGRAPHS: As part of the realization of the communication of the Establishment and the activities or animations, photographic negatives can be produced and used on the communication brochures of the Establishment. Acceptance of the rental conditions entails acceptance of the rights to use these photos without being able to claim image rights, whether for adults, children or adolescents. In the event of refusal of this clause, a written certificate must be submitted to the establishment manager before the end of your stay. If necessary, this clause will be considered accepted and cannot be challenged later for any reason whatsoever. DISPUTE CONSUMER MEDIATION: In the event of a dispute between the Customer and the company, they will endeavor to resolve it amicably (the Customer will send a written complaint to the Customer Relations Department of the Manufacturer or that of the Seller ). In the absence of an amicable agreement or in the absence of a response from the professional within a reasonable period of one (1) month, the Consumer Customer within the meaning of Article L.133-4 of the Consumer Code has the possibility of enter free of charge, if a disagreement remains, the competent mediator registered on the list of mediators drawn up by the Commission for the evaluation and control of consumer mediation pursuant to Article L.615-1 of the Consumer Code, namely: The Professional Mediation Company - www.mediateur-consommation-smp.fr - 24 rue Albert de Mun - 33000 Bordeaux
21- Guests of the Domaine de l'Eau Vive cottage acknowledge accepting these regulations and complying with these provisions.
Non-refundable your reservation is out of time for a free cancellation : CANCELATION :
